REAL ID… Denies your rights?

Congress passed the REAL ID Act in response to the Sept 11 report. It established a national registry, by allowing the Federal government full access to the States’ various drivers license lists.

Some states have agreed to go along with it from the start and some held out until they were threat… err… coerced to voluntarily comply. My state(South Carolina) stood on the principal that this information was proprietary and private to the State and passed an Act stating that they will never enact the REAL ID act in the State. Well after 8 or so years, when the threats of SC citizens being unable to fly, go into a federal Courthouse or base, they caved to Federal pressure and repealed their Act.

So my question is simple. How does a person refusing to get a REAL ID, and thus barred from entering courthouses, file for a redress on being denied access to Federal courthouses, since access to court is a declared Right for both criminal and civil law (greater than $20)?

Matthew, with Real ID, is there not a provision for using your passport? I know not everyone has a passport and to get one is a little bit of a pain, and a little expense. I’m in California and because I have a passport, I never bothered to go through the hassle to go to the DMV of California and stand in hours long lines, just to be Real ID compliant.
Using a passport you already have to board a domestic plane flight, keeps your principals intact with regards to your drivers license info.

Why don’t you just make an appointment at the DMV? I’ve done it and I didn’t have to wait more than 10 minutes..I live in California too. Last time I renewed my passport it cost $60…about 8 years ago. Good idea to use a passport to ‘keep principles intact’.

Barbara. In Santa Cruz county…we have 2 dmv offices. One at each of the 2 major population centers. I’ve made appointments before. 1.5 hour waits pre Wuhan Corlnavirus. Now…longer. what i CAN do with CA DMV online I do gladly. Its quite good. You must live in a place with a Highly efficient DMV. 20 minute wait? Lucky you.

My question is not if there is a workaround to the REAL ID. If you want to travel outside of the USofA you need a passport, which is a Federal ID. If one does not wish to register with the Federal government, and does not want their drivers info to be linked with a national database, is their own choices as to why.
All of the REAL ID info says that you cannot fly Or enter federal buildings(including courts) without one. The whole point of having an ID, like a drivers license, is that you have been guaranteed by your State that you are who you claim to be. My State, the only difference between a compliant or non-compliant ID is that there is a gold star on it (the non-compliant also state “not for federal ID”).
If one wants does not get a REAL ID, and is prevented from entering a Federal Courthouse, how can they seek restitution for being prevented from exercising your Right to use the Federal Court to complain about your deprivation of rights?
